Netsertive is committed to promoting the free-flowing exchange of expression relating to your marketing and advertising initiatives, while maintaining standards consistent with all applicable U.S. federal, state, and local laws, International laws, advertising industry codes and guidelines, and the professional standards of the online community. Client, or any user gaining access to the Site at Client’s direction or by using Client’s credentials, may not process, digitize, post, display, upload, store, share, or otherwise distribute on (or from) the Netsertive website or any Netsertive system (“Site(s)”) any of the following information or content (“Prohibited Content”):
Content or material that:
we believe (acting reasonably) is illegal,
includes nudity or that we believe (acting reasonably) is, directly or by implication, pornographic, vulgar, obscene, or excessively violent in nature,
we believe (acting reasonably) is grossly offensive to the online community, including but not limited to, blatant expressions of bigotry, prejudice, racism, hatred, and profanity,
unlawfully uses or exploits children under the age of majority (the “Age of Majority”) in the jurisdiction where they reside or posts or discloses any personally identifying information about children under the Age of Majority,
promotes or provides instructional information about illegal activities.
Information (personal or otherwise) about an individual for malevolent purposes, including libel, slander, defamation, violation of an individual’s right to privacy, or any infringement of privacy or harm to reputation.
Copyrighted content or material that we believe (acting reasonably) is used without the express permission of the owner (including, but not limited to, photographs and other images, video and audio material published in books, magazines, CDs, posters, calendars, broadcasts, websites, and other media generally protected by copyright law).
Netsertive does not generally examine content and material used on the Sites. However, any materials used on the Sites may be examined by Netsertive from time to time and Netsertive retains sole discretion to decide, without notice, if certain content or material should be removed or prohibited. Additionally, Netsertive retains sole discretion to revoke Client’s right to use the Sites based on violations of this content policy.
Notwithstanding the foregoing, each user of the Sites is solely responsible and liable for the content and material used on the Sites. While visiting or using the Sites, each user may be exposed to content or materials considered to be offensive, and Client and each user acknowledge and agree by visiting any such Site, that the visiting and use of the Sites is done at each user’s sole discretion.
Copyright of Site Material
All materials on the Site are protected by copyright laws. A user may not, without advanced written permission of the owner of the copyright, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any copyrighted material in any format, electronic or otherwise.
Copyright of Client Material
When Client chooses to share content or material publicly, Client’s image, audio, video and other files may be made available for viewing by others using the Sites. Netsertive may incorporate your content and material in directories, search results or in any other places on the Sites which are available to others on the Sites. Client may only use content or other materials to which Client owns the copyright or otherwise holds permission from the copyright owner to use on the Sites.
Concerns or Complaints
The content and material on the Sites comes from a variety of sources, including Netsertive clients, partners and certain content commissioned or produced by Netsertive and its technology. If you have any concerns about the nature of specific content that is being displayed or believe that you are the owner of copyrighted material found on the Sites, please contact us at content@netsertive.com. It is our practice to follow the guidelines against copyright infringement outlined in the Digital Millennium Copyright Act of 1998, commonly known as the DMCA, located at https://www.copyright.gov/dmca.
